These General Conditions of Use and Service  (hereinafter, “General Conditions”) govern access to and use of the Website, which is accessible through the domain name http://itworldedu.com and its sub-domains (hereinafter, the “Website”), and also regulates how services are contracted through it.

Any person who merely accesses the Website thereby becomes a User of the same (hereinafter, the “User”) and implies acceptance of all the terms included in these General Conditions. If the User does not agree with these General Conditions, he or she must leave the Website immediately without using it.

By accepting these General Conditions, the User states that he or she:

• Has read and understood what is stated herein.
• Has the sufficient capacity to sign up for a product and/or service, if willing to do so.
• Assumes all the obligations set forth herein.

1. General information about the Website

2. Website access

Simply accessing the website is free of charge, except for the cost of connecting through the telecommunications network provided by the access provider hired by the User.

3. Website rules of use

The User must use the Website and all its content and services in accordance with what is established by law, morals, public order and these General Conditions and must not use its content and services to carry out illicit or criminal activities that violate the rights of third parties and/or that violate any norms of the applicable legal system.

The User agrees not to:

1. Introduce or spread content or propaganda of a racist, xenophobic or pornographic nature, or that advocates terrorism or violates human rights.
2. Introduce or spread data programs (viruses and malware) on the network that could cause damage to the computer systems of the access provider, its suppliers or third-party Internet users.
3. Spread, transmit or make available to third parties any kind of information, element or content that violates the fundamental rights and public freedoms recognised in the Spanish Constitution and in international treaties.
4. Spread, transmit or make available to third parties any kind of information, element or content that constitutes unlawful or unfair advertising.
5. Transmit unsolicited or unauthorised advertising, advertising material, “junk mail”, “chain letters”, “pyramid schemes” or any other kind of solicitation, except in areas that have been exclusively designed for that, like commercial spaces.
6. Introduce or spread any false, ambiguous or inaccurate information and content in a way that misleads those who receive the information.
7. Impersonate other Users by using their registry keys or passwords to the different services and/or content of the Website.
8. Spread, transmit or make available to third parties any kind of information, element or content that constitutes a violation of intellectual and industrial property rights, patents, trademarks or copyrights held by the owners of the Website or third parties.
9. Spread, transmit or make available to third parties any kind of information, element or content that constitutes a violation of the privacy of communication and legislation on personal data.

The User agrees to hold Edutech CLUSTER and FUNDACIÓN EURECAT (joint organisers of ITworldEdu) harmless against any possible, claim, fine, penalty or sanction that may be required as a result of the User’s failure to comply with any of the previously indicated rules of use. Moreover, Edutech CLUSTER and FUNDACIÓN EURECAT reserve the right to sue for any damages that it may incur.

4. Content and services linked through the Website

The Website may contain technical linking devices, directories and even search tools enabling the User to access other web pages and portals (hereinafter, “Linked Sites”). In these cases, Edutech CLUSTER and FUNDACIÓN EURECAT will only be responsible for the content and services provided in the Linked Sites insofar that they have actual knowledge of their illegality and have not deactivated the link to them with due diligence. In the event that the User thinks that there is a Linked Site with illegal or inappropriate content, he or she may notify Edutech CLUSTER and FUNDACIÓN EURECAT, although in no way does this notification oblige Edutech CLUSTER and FUNDACIÓN EURECAT to remove the link in question.

In no way may the existence of Linked Sites imply the formulation of agreements between Edutech CLUSTER and FUNDACIÓN EURECAT and their managers or owners; nor may it suggest that Edutech CLUSTER and FUNDACIÓN EURECAT recommend or promote the Linked Sites and/or their content.

Unless expressly stated otherwise on the Website, Edutech CLUSTER and FUNDACIÓN EURECAT do not know the content and services of the Linked Sites. Therefore, they are not liable for the damages that their unlawfulness, quality, outdatedness, unavailability, error and uselessness may cause to the User or any third party.

5. Intellectual and industrial property

All the content of the Website, including but not limited to the texts, photographs, graphics, images, icons, technology, software, links and other audiovisual and sound content, as well as its graphic design and source codes, are the intellectual property of Edutech CLUSTER and FUNDACIÓN EURECAT or third parties, without any of the exploitation rights recognised over them by current intellectual property legislation being understood as transferred to the User.

The trademarks, trade names or distinctive signs published on the Website are the property of Edutech CLUSTER or third parties, without any rights over them being understood as transferred to the User.

Edutech CLUSTER does not represent or maintain commercial agreements with the owners of the brands of the products that it sells.

Edutech CLUSTER and FUNDACIÓN EURECAT inform Users who wish to sign up for the talks announced on the Website that any material provided to Edutech CLUSTER and FUNDACIÓN EURECAT will continue to be property of the author in accordance with current intellectual property legislation.

In any case, the User declares that the material submitted to Edutech CLUSTER and FUNDACIÓN EURECAT does not violate the intellectual and/or industrial property rights of third parties. The User agrees to hold Edutech CLUSTER and FUNDACIÓN EURECAT completely free of any penalty, sanction or claim potentially affecting Edutech CLUSTER and FUNDACIÓN EURECAT as a result of the User’s non-compliance with the copyrights of third parties.

6. Registration and payment procedure

Once the User has selected the event offered through the Website, he or she must fill out the attendee information and billing information in the following fields:

The User will be linked to the virtual point of sale (POS) of BBVA, where he or she will begin the payment process with a credit card, filling in the information corresponding to the payment method and proceeding with the payment.

Once the payment process is validated, the User will receive the following documentation at the email address indicated in the Attendee Information section:

1. First email confirming the completed order with the information related to the event for which payment was made (receipt) and with the order reference number. This reference number uniquely identifies the purchase made through the Website and is how the staff of EDUTECH CLUSTER and FUNDACIÓN EURECAT can identify your purchase if you need to ask us any questions.
2. Email with a PDF that will include an invoice for the amount of the order with the billing information entered in the previous form.
3. Email with confirmation of registration to the ITworldEdu congress

EDUTECH CLUSTER and FUNDACIÓN EURECAT will keep electronic proof of the purchase made by the User, although it will not be made available to him or her.

7. Data Protection

Purpose of the processing: we process the data and the information provided to us by the interested parties in order to:

1. Manage the use of the features made available through the website, including the response to requests and/or inquiries made. The data processed for this purpose will be kept as long as the contractual and/or business relationship between the User and Edutech CLUSTER is maintained. If the requests made by a User do not maintain a contractual relationship, the data will be kept until the request has been resolved.
2. Keep Users of Edutech CLUSTER products and/or services informed, via email or equivalent electronic means of communication, provided the User has given their consent by checking the corresponding box.

Legitimation: the processing of this data is legitimised for carrying out contractual and/or business obligations.

Data retention criteria: the data will not be kept for any longer than is necessary for the purpose of their collection, unless there is a legal obligation to do so.

Communication of the data: the data will not be communicated to a third party, except when legally obligated to do so or with the interested party’s express consent.

International data transfers: international data transfers are not made to third countries outside the European Union.

Rights of the interested party: the interested party has the right to withdraw consent at any time. Thus, we inform you that you may exercise your rights of access, rectification and deletion (right to be forgotten), data limitation, data portability and opposition by sending a letter to Via Augusta 29, 1º, 08006 Barcelona (Spain) or by sending an email to info@edutech.cat.

Likewise, the interested party is informed that he may revoke his consent for receiving commercial notifications by sending an email to info@edutech.cat.

The interested party can file a complaint with the competent data protection control authority, which is currently the Spanish Data Protection Agency (AEPD), through its electronic headquarters:  www.sedeagpd.gob.es/sede-electronica-web, or by sending a letter to C/ Jorge Juan nº 6, 28001 MADRID.

8. Correction and identification of data entry mistakes

If the User forgets to fill in any information marked as required in the ticket payment form by a red asterisk, he or she will not be able to continue the payment or validation process until it is complete. A message at the top of the screen will indicate the pending fields to fill out, as well as acceptance of the terms and conditions.

9. Ticket validation

If the User does not print his or her ticket in advance, he or she may request a copy from the congress by contacting the confirmation desk. In this case, the User must present a valid form of identification to pick up the ticket (national identification card or passport). You may pick up your ticket from the box office during opening hours on the same day of the event.

10. Price and shipping costs

The prices indicated for each ticket are exempt of Value Added Tax (VAT) under Article 20.1.9 of Law 37/1992 on the Value Added Tax and are listed in Euros (€).

11. Billing

The User understands and accepts that Edutech CLUSTER and FUNDACIÓN EURECAT will only send his or her invoice to the email address provided during the registration process.

12. Right of withdrawal

Before purchasing the tickets, the User must ensure the accuracy and appropriateness of the data provided, since the tickets cannot be returned once they are purchased. Your inability to attend the event or mistakes made when buying the tickets are not valid reasons for returning them. Tickets can only be cancelled due to possible technical or operational incidents attributable to Edutech CLUSTER and FUNDACIÓN EURECAT. In this sense, the User may not exercise the right of withdrawal or cancellation provided for in Article 103 of Law 3/2014, of 27 March, which modifies the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Legislative Royal Decree 1/2007, of 16 November, since the exercise thereof is excluded.

Notwithstanding the foregoing, when a purchase has been made fraudulently or improperly, using the credit or debit card number, the card holder may ask Edutech CLUSTER and FUNDACIÓN EURECAT to cancel the charge as long as proof of a report of these events is submitted. In this case, the amount paid for the tickets will be returned when requested in writing. This request must include the documents (report) that prove the loss or theft of the card with which the payment was made.

13. Complaints, claims and requests for information

The User may address complaints, claims or requests for information to Edutech CLUSTER and FUNDACIÓN EURECAT’s Customer Service team using any of the following methods:

By calling the telephone number (+34) 932 381 400 from Monday to Thursday (from 9 am to 2 pm and from 3 pm to 6 pm) and Friday from 9 am to 3 pm.

Edutech CLUSTER and FUNDACIÓN EURECAT will respond to the claims received in the shortest possible time. In any case, it will respond within a maximum period of one month from when the claim is submitted.

Edutech CLUSTER and FUNDACIÓN EURECAT will provide the User with an identification code and written proof by email or in a way that confirms reception of the User’s complaint or claim.

14. Nullity or ineffectiveness of the clauses

If any clause included in these General Conditions is declared fully or partially null or ineffective, that nullity or ineffectiveness will only affect the provision or the part of the same that is found to be null and ineffective. These General Conditions will remain valid for everything else, the provision in question considered fully or partially excluded.

15. Applicable legislation

These General Conditions will be governed and interpreted in accordance with Spanish legislation.

16. Competent jurisdiction

In the event of litigation between Edutech CLUSTER and FUNDACIÓN EURECAT and the User, the latter may file a suit before the Spanish courts corresponding to the domicile of Edutech CLUSTER, of before the courts of the place where the User is domiciled.
